Recommendations

Our tours are not recommended for people who are physically challenged, those who suffer with cardiac, respiratory or back problems, ailments that lead to loss of consciousness, hydrophobic, pregnant women, children under 4 years nor people who do not have basic swimming skills (for aquatic activities). People under the influence of alcohol or drugs will not be allowed to participate. Children age 0-11 year can be asked an ID as proof of age.

Terms & Conditions – Waiver of Liability

By booking any tour with ISLA SEA TOURS, you (the “Participant”) acknowledge, understand, and agree to the following terms:

1. Assumption of Risk

You understand that participation in marine activities, including but not limited to whale shark tours, snorkeling, swimming, and boating, involves inherent risks such as injury, illness, drowning, encounters with marine life, and adverse weather or sea conditions. By booking, you voluntarily assume all risks associated with the activity.

2. Release of Liability

You hereby release, waive, and discharge ISLA SEA TOURS, its owners, employees, agents, and affiliates from any and all claims, demands, or causes of action for personal injury, property damage, or wrongful death arising out of participation in any activity, whether caused by negligence or otherwise, to the fullest extent permitted by law.

3. Medical Fitness

You declare that you are physically able to swim, and free from any condition that would prevent safe participation. You agree to inform the crew of any medical conditions or limitations prior to departure.

4. Compliance with Instructions

You agree to follow all instructions from the captain, crew, and guides at all times. Failure to comply with safety rules may result in termination of your participation without refund.

5. Weather & Itinerary Changes

Marine tours are subject to weather, sea conditions, and official regulations. The company reserves the right to modify, reschedule, or cancel tours without prior notice for safety reasons.

6. Refund & Cancellation Policy

• You can cancel or change the date of your tour up to 24 hours before departure for a full refund or a date change.
• Cancellations or changes made less than 24 hours before the tour, and no-shows, are non-refundable.
• If the port authority does not allow tours because of weather or safety concerns, you can change your date or receive a full refund.

7. Photography & Media Release

You consent to the use of photographs and/or video taken during the activity for promotional purposes, without compensation.

8. Acceptance of Terms

By booking and/or participating in any tour, you confirm that you have read, understood, and accepted these terms, and that you are booking on behalf of yourself and all members of your party.
